JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-04-2018 The petitioners seek bail in anticipation of their arrest in connection with I.F. Case No. 45 of 2016, dated 24.05.2016, instituted for the offences punishable under Sections 2, 4, 27, 29, 50 and 51 of the Wild Life Protection Act, 1972.

The petitioners and many others are said to have entered the reserved forest area for felling trees. Out of the

Patna High Court Cr.Misc. No.24678 of 2018 (2) dt.25-04-2018 2/2 miscreants, two were spotted with torch light by the team which had gone to nab the miscreants. However, none of the miscreants could be apprehended. The names of the petitioners have come only on suspicion that they also had entered the forest area. The petitioners have no idea as to who has named them.

The petitioners are land-less labourers who are made to work by the forest authorities, but are not paid their wages. When a protest was made for the payment of the wages for the work which the petitioners had performed in the past, they have been made accused in this case. For the paucity of any direct material against the petitioners above named, they are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bagaha, West Champaran, in connection with I.F. Case No. 45 of 2016.
