Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 353,504, 349, 354, 34 of the Indian Penal Code.

It is alleged by the informant that when his daughter was coming from the court after hearing of a Bail Petition No. 4002 of 2016, this petitioner along with his brother Rohit Bhagat attacked the informant with screw driver on his face, near eye and chick.

It is submitted on behalf of the petitioner that a case

Patna High Court Cr.Misc. No.19606 of 2017 (3) dt.02-05-2017 2/2 under Section 498(A) of the Indian Penal Code between this petitioner and the daughter of the informant is pending. It is further submitted that the nature of injury was simple as it appears from the impugned order of the learned Sessions Judge. The petitioner is in jail custody since 24.12.2016. Considering the aforesaid facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in Gopalganj P.S.Case No. 538 of 2016, subject to the condition that both the bailors will be close relative of the petitioner.
