Petitioner apprehends his arrest in Chowk P.S. Case No.207 of 2014 instituted for the offence under Section(s) 420, 406, 120-B Indian Penal Code and Section 81(1)(C), 81(2) and 81(4) of the Bihar VAT Act pending in the Court of the Additional Chief Judicial Magistrate, II, Patna City, Patna. Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 20.12.2017 passed in Cr. Misc. No.62376 of 2017.
This fresh anticipatory bail application has been filed on the ground that this petitioner in some other case of
Patna High Court Cr.Misc. No.15574 of 2018 (2) dt.25-04-2018 2/2 similar nature has been granted anticipatory bail by order dated 11.01.2018 passed in Cr. Misc. No.62179 of 2017. This Court is of the view that it may be good ground for regular bail, but not for reconsideration of anticipatory bail, which has already been rejected on 20.12.2017. In such circumstances, this Court is not inclined to grant anticipatory bail to petitioner.
Prayer of the petitioner for grant of anticipatory bail is again rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
