The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.

As per the F.I.R., the bike of the informant standing at the door of his house, was stolen by unknown thief. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is made accused on the confessional statement of the co-accused Mithun Kumar. He submits that no any kind of recovery has been made from petitioner rather motorcycle was recovered from Dilkhus Kumar. He further submits that petitioner has no criminal

Learned APP for the State opposes the prayer for bail and submits that petitioner is also involved in the present case. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner in connection with Birpur P.S. Case No. 54/2022.

Accordingly his prayer for anticipatory bail is hereby rejected.
