Learned counsel Mr. Raj Dular Sah for the respondents is present.

He has submitted that this writ application has become infructuous because there was no interim stay in the writ application and Title Suit No.54 of 1997 has already been disposed of by the judgment and decree dated 29.01.2013 by learned Munsif, Khagaria. Photocopy of the judgment is produced before this Court for ready reference.

From perusal of the photocopy of the judgment, it appears that Title Suit No.54 of 1997 has already been disposed of and this writ application arises out of order dated 12.07.2010 passed in Title Suit No.54 of 1997.

Thus, this writ application has become infructuous and accordingly, it is dismissed.
