The petitioner is accused in connection with Hajipur Sadar P.S. Case No. 132 of 2015 for the offence under Sections 147, 148, 149, 452, 504, 506, 364, 427, 380, 307, 302, 324 and 326 of the Indian Penal Code.
A large number of persons have been made accused in this case. From perusal of the F.I.R. it appears that omnibus allegation was leveled against the members of the mob. This Hon'ble Court has granted bail to Sameena Khatoon, Md. Saukat Ali @ Md. Sokat Ali and Md. Sahzad on 05.10.2015 passed in Criminal Miscellaneous No. 24149 of 2015 and Md. Govinda, Md. Sonu and Khursid was granted bail on 09.05.2016 passed in
Patna High Court Cr.Misc. No.21038 of 2017 (4) dt.30-05-2017 2/2 Criminal Miscellaneous No. 19592 of 2016. There is specific statement in para 3 of the petition that petitioner has no criminal antecedent.
Having regard to the statement made in para 3 of the petition and the fact that there is no specific overt act alleged against the petitioner and the similarly situated co-accused have been granted bail by this Hon'ble Court, as stated above. Let the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur or his successor Court in connection with Hajipur Sadar P.S. Case No. 132 of 2015 on the condition that the petitioner shall co-operate in the trial and will not in any manner influence the evidence or the witnesses. (Anil Kumar Upadhyay, J) manish/- U T
