The petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 11.02.2021 and chargesheet has been submitted. Petitioner has antecedent of three cases. Learned counsel for the petitioner submits that informant alleges that on 09.02.2021 at about 12 am, some unknown thieves broke the wall of his shop from the back side and took away Rs.800/- and a mobile.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the

Based on that incident and showing recovery from his house, when the cash and articles were recovered, it belonged to the petitioner and were not stolen articles. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.02.2021 and chargesheet has been submitted in the case and considering the nature of allegations as alleged, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Pupari P.S. Case No. 47 of 2021.
