Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek regular bail in connection with Sarsi P.S. Case No. 119 of 2022, lodged under Sections 406, 302/120(B) of the Indian Penal Code read with Section 27 of Arms Act.
As per prosecution case, the informant has disclosed on the basis of suspicion that her husband was working under the accused petitioners and under conspiracy they killed her husband. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. He further submits that it has come during investigation that they were going, then robbery took place and the robberer have opened
Patna High Court CR. MISC. No.55848 of 2022(2) dt.08-12-2022 2/2 fire, due to which the husband of informant died. He also submits that antecedents of petitioners are clean and they are in custody since 07.06.2022. He further submits that Police has submitted final form in this case and Court has taken cognizance and the petitioners are law abiding citizens.
Learned counsel for the State opposes the prayer for bail and submits that from the investigation, it transpires that they have not played proper role to safe the life of husband of the informant.
In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Sarsi P.S. Case No. 119 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
