Petitioner is languishing in custody since 21.01.2017 in connection with Turkauliya (Banjariya) P.S. Case No. 36/2017 for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel, is that during patrolling they saw the petitioner carrying a bag, on which he was apprehended with 6.48 litres of foreign liquor, and, accordingly, seizure-list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Turkauliya (Banjariya) P.S.
