JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Liquor was allegedly recovered from the house of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Submission of the petitioner is that the petitioner was a licence holder for the business of liquor. However, abruptly licence was cancelled. Hence, it was difficult for the petitioner to dispose of the available liquor so expeditiously. Considering the aforesaid facts, let petitioner, above

No.21392 of 2017 (2) dt.03-05-2017 2/2 named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Saran at Chapra/Successor Court, in connection with Chapra Town P.S. Case No.130 of 2017, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
