2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, petitioner is alleged to have assaulted with butt of pistol on the head of the informant.
4. Learned counsel for the petitioner submits that both parties are agnates and due to dispute over share in the ancestral property this false and concocted case has been lodged against the petitioner. Injury allegedly caused by the petitioner is simple in nature.
5. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender
Patna High Court CR. MISC. No.55687 of 2023(2) dt.29-08-2023 2/2 before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Tarari P. S. Case No. 67 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
