HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 08-09-2023 Heard Mr Yogesh Chandra Verma, learned senior counsel duly assisted by Mr Braj Bhushan Poddar, learned counsel for the petitioner and Mr Jitendra Kumar Singh, learned APP for the State.

2 Earlier, the petitioner had moved this Court for grant of anticipatory bail in Cr Misc No 17316 of 2023 which was allowed with conditions on 24.05.2023.

3 Later, a modification petition was filed vide Cr Misc No 42358 of 2023 in which the petitioner wanted amongst others, his exemption from attending the Police Station. Accordingly, the same was rejected on 19.07.2023. In view of the fact that Cr Misc No 42358 of 2023 was rejected, now instead of surrendering before the concerned Court, this anticipatory bail application has been preferred.

No.56653 of 2023(2) dt.08-09-2023 2/2 4 Considering the facts on record, the attitude of the petitioner, his tendency to avoid arrest at any cost despite the fact that the FIR was lodged on 11.05.2022, more than a year from today, this Court is not inclined to grant the petitioner any relief and this anticipatory bail application stands rejected. 5 The FIR is of 11.05.2022. For about one and half year, the petitioner is roaming free and at will filing anticipatory bail application/modification application followed by second anticipatory bail application.

6 The Superintendent of Police, Begusarai should file a report and explain why such a big rope has been extended to the petitioner who is avoiding his arrest for the last one and half year.

7 Office shall take steps for sending this order to the Superintendent of Police, Begusarai.

8 Report should be submitted to this Court in a sealed cover within four weeks from today.

9 Let this matter come under the heading To Be Mentioned once the report is submitted.
