JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Fulwaria P.S. Case No. 120 of 2021 instituted for the offences under Sections 188, 120(B) of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 31.07.2021, is a person with clean antecedent and charge-sheet has been submitted. Allegation is of recovery of 905.4 litre of liquor from a pick-up van and a Tiago Car out of which 819 litre was recovered from a pick-up van.

No.64697 of 2021(2) dt.04-02-2022 2/2 Learned counsel for the petitioner submits that both the vehicles were parked near Maa Bhagwati Line Hotel as the petitioners had gone to have their meal and it appears that someone kept the liquor in the aforesaid vehicles. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Fulwaria P.S. Case No. 120 of 2021.
