The petitioner seeks bail in Saraiya (Jaitpur O.P) P.S. Case No. 724 of 2019, registered for the offence under Section 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

530 liters & 460 ml. of illicit foreign liquor has been recovered from a Bolero vehicle and name of petitioner has come during course of investigation and he has been remanded in this case from Saraiya P.S. Case No. 499 of 2021. It is submitted on behalf of petitioner that petitioner has not been arrested on spot and no incriminating article has been recovered from his possession. Petitioner is neither owner nor driver of the vehicle in question and he is in custody in this case since 24.08.2021.

No.64954 of 2021(3) dt.14-02-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has got criminal antecedent and he is accused in altogether sixteen cases. Considering the aforesaid facts and circumstances as well as criminal antecedent of the petitioner, the bail petition of petitioner is rejected at this stage.
