JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioners were initially made accused in connection with Bairiya P.S. Case No. 268 of 2017 which was instituted for the offences under Sections 341, 323, 380, 447, 448 and 504/34 of the Indian Penal Code.
During the pendency of the investigation, the petitioners were noticed under Section 41(a) of the Code of Criminal Procedure and the petitioners had responded to the aforesaid notice. During the entire period of investigation, they cooperated with the police. Later, charge sheet has been submitted under Sections 447, 341, 323, 325, 354(B) and 504/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.21399 of 2018(2) dt.26-04-2018 2/2 Learned counsel for the petitioners is permitted to withdraw the present petition in order to approach the court below and seek regular bail who shall take into account that the petitioners had participated in the investigation and had responded to the notice under Section 41(a) Cr.P.C. and shall pass necessary orders in accordance with law, preferably on the same day. The petition stands dismissed as withdrawn with liberty aforesaid.
