JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Kotwali P.S. Case No. 17 of 2020, instituted for the offences under Section 30(a), 37(2) of Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 05.08.2021, charge-sheet has been submitted and has antecedent of one case under the Excise Act and allegation is of recovery of 30 litres of liquor from the house of petitioner.

The learned counsel submits that the house is a joint family property, as such, the petitioner was not aware who had kept the liquor in the house.

Considering the fact the petitioner is in custody since 05.08.2021, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. S.J.-II-cum-Special Judge, Excise, Gaya, in connection with Kotwali P.S. Case No. 17 of 2020. The application stands allowed.
