JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-05-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdrawn the anticipatory bail petition of petitioner petitioner No.3, Raj Kishore Rai. Prayer is allowed.

This anticipatory bail petition is dismissed as withdrawn against petitioner No. 3.

Heard learned counsel for the petitioners and the State.

Petitioners No.1 and 2 apprehend their arrest in a case registered for the offence punishable under Section 304B, 201/34 of the Indian Penal Code.

The accusation is of killing the niece of the informant due to non-fulfillment of demand of four wheeler and to burn

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Petitioner No.1 is married Nanad of the deceased and petitioner No.2 is elder sister in law of the deceased and they have got no concern with the family affairs of the deceased or her husband. Thrust of accusation is against the husband of deceased who is in custody. Petitioners claim clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioner, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIX, Vaishali at Hajipur in connection with Tisiauta PS case No. 38/2018, subject to conditions laid down u/s 438(2) of the Cr. P. C.
