The petitioner is in judicial custody in connection with Kateya P.S. Case No.247 of 2021 instituted under Section 376(D) of the Indian Penal Code and 4/6 of the POCSO Act. As per the allegation in the FIR, it is a gang rape by the accused persons as has been alleged by the victim girl (x). She has stated in the FIR that all the five persons had raped her while accused Dipu Dubey had video-graphed the entire incident. She has further alleged that the accused persons had threatened that in case she discloses the incident to anyone her video will be made viral.

It is alleged that later they again approached her and threatened that in case she fails to meet them, the video will be made viral. Being disturbed, she informed the family member and later they went to police station and the FIR was lodged.

Patna High Court CR. MISC. No.65103 of 2021(3) dt.12-05-2022 2/2 Considering the grave allegation that has been levelled in the FIR by the victim the girl (x), this Court is not inclined to grant any relief to the petitioner herein and the bail application is hereby rejected.

It is expected that the Trial court will consider the kind of case and take all possible steps to take the Trial and conclude it expeditiously.
