In this case the petitioner is seeking pre-arrest bail in Buddha Colony P.S. Case No.278 of 2017 for the offence under Sections 307, 147, 148, 149, 341, 323, 504, 506 of I.P.C. and Section 27 of the Arms Act.
As per the F.I.R. it appears that accused persons surrounded the informant and one person of Rajapur had assaulted him with rod. It is further alleged that the victim was taken to behind Kali Mandir in order to kill him but police came and saved the life of the victim.
Counsel for the petitioner submits that this case is identical to the case of Nikhil who has already been granted
Patna High Court Cr.Misc. No.22598 of 2018 (2) dt.26-04-2018 2/2 anticipatory bail by this Court vide order dated 19.01.2018 passed in Cr.Misc.No.56511/17.
Looking to the fact of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Patna, in Buddha Colony P.S.Case No.278 of 2017 subject to the conditions as laid down under section 438(2) of Cr.P.C. and further condition is that whenever the police will call the petitioner, he will present himself for the purpose of investigation, in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel his bail bond.
