2. The petitioner is in custody in connection with S.T. No. 287 of 2022 arising out of Saharsa Sadar P.S. Case No. 936 of 2021 for the offence under sections 147, 148, 149, 302, 201, 120B of the Indian Penal Code and 27 of the Arms Act lodged on 06.12.2021 by the informant, Anil Kumar.

3. As per the prosecution story, the informant alleged that on 05.12.2021, at around 2-3 p.m. his son was murdered by hatching conspiracy by the petitioner along with other accused and some unknown persons in which petitioner and other one by one fired upon his son. Accordingly, the F.I.R.

4. Leaned counsel for the petitioner submits that there is no eyewitness to the said occurrence and informant too has

Patna High Court CR. MISC. No.57521 of 2024(3) dt.21-01-2025 2/3 got knowledge through local people, he has remained in custody since 10.03.2022 (para-12 of the petition) and has one criminal antecedent.

5. Learned APP opposed the prayer by submitting that his role has come in the occurrence.

6. In this case, on earlier occasion, a report was called for and as per the report submitted by learned Additional District & Sessions Judge 3rd, Saharsa, it is pending for prosecution witness.

7. Considering the submissions put forward by the parties as also the fact that the petitioner is in custody since 10.03.2022 and there is a delay in conclusion of the trial and an undertaking has been given that he shall be diligently appearing in the trial, this Court is inclined to extend him the privilege of bail

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge 3rd, Saharsa in connection with aforesaid P.S. Case subject to the following conditions: (i) one of the bailors should be the family member/relative of the petitioner who shall provide official

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for next one year to mark his attendance;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) perwez U T
