The application seeks a direction upon the respondents to continue payment of amount under the J.P. Sanani Samman Yojna. It appears that the respondent-District Magistrate under order dated 12.01.2012 found that the said pension was granted in favour of the petitioner in an irregular manner as no sufficient document was produced. The payment of pension under the said scheme/Yojna was therefore withdrawn and the amount already paid was directed to be realized.

Counsel for the State has rightly pointed out that the said order passed by respondent no.3 (Annexure-4) is not under

Patna High Court CWJC No.12520 of 2012 (4) dt.06-10-2015 2/2 challenge.

If that be so, no relief, as prayed for, can be granted to the petitioner. The application is dismissed.
