In this case the petitioner is seeking pre-arrest bail in Baisi P.S. Case No.231 of 2017 for the offence under Section 7 of E.C. Act.

As per the F.I.R. the police had inspected the pick up van having Registration No.BR11Ga-3751 and found 55.30 quintal rice and 4 quintal paddy claiming to be of P.D.S.grain. Counsel for the petitioner submits that petitioner is the owner of the vehicle and he is not concerned with the seized grain. Merely his vehicle has been seized and he has no concern with grain.

Looking to the fact that the petitioner is not a P.D.S. dealer, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.22636 of 2018 (2) dt.26-04-2018 2/2 before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Purnea, in Baisi P.S.Case No.231 of 2017 subject to the conditions as laid down under section 438(2) of Cr.P.C.
