Heard the learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Uchakagaon P.S. Case No. 234 of 2021 registered for offence punishable under sections 341, 323, 324, 307, 354, 504, 506, 379/34 of the Indian Penal Code.

As per allegation, co-accused Babu Hussain Miyan and Arman Miyan were selling liquor in the already closed shop of the informant.When the informant and her daughter complained,

Patna High Court CR. MISC. No.64983 of 2021(2) dt.21-07-2022 2/2 co-accused persons assaulted the members of the prosecution side. The specific allegation against the petitioner is that he inflicted deadly rod blow on the head of Moni Kumari, the daughter of the informant.

As per medical report, as mentioned in the impugned order, injured Moni Kumari received fracture of right parietal region of skull, which is grievous in nature. Considering the above-mentioned facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
