Pursuant to order dated 31.08.2015, the Registrar and Finance Officer of the Magadh University are present. The Incharge, Legal Cell of the University is also present. Show cause has been filed on behalf of respondents no. 7 and 8. Second supplementary counter affidavit has also been filed on behalf of respondents no. 5 to 8. Further, affidavits have been filed on behalf of respondents no. 7 and 8 as well as the Incharge, Legal Cell of the University.
From the materials brought on record in the supplementary counter affidavit, it appears that P.P.O. dated
Patna High Court CWJC No.16326 of 2011 dt.03-09-2015 2/2 01.09.2015 has been issued in favour of the petitioner which in effect satisfies the claim raised in the writ petition. In view of the apology tendered by the officers with regard to their non appearance before the Court earlier, the Court accepts the same and does not propose to proceed against them any further. However, they are cautioned to be careful in future. The application stands disposed off However, if the petitioner feels that there is some error in the calculation made by the University, it shall be open to him to file an appropriate representation before the respondents no. 7 and 8 within four weeks from today along with a copy of this order. If such a representation is filed, the concerned respondents shall look into the matter and pass appropriate orders within three weeks from the date of submission of the representation. If anything further is found payable to the petitioner, the same shall also be paid within three weeks thereafter.
