JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 414 of the I.P.C. as well as 25(1b)a/26/35/25(1-A)/25(1-AA)/25(1-AAA) of the Arms Act and 3⁄4 of the Explosive Substance Act and 16, 17, 18, 18A, 19, 20 and 21 of the U.A.P. Act.
The prosecution story, in brief, is that on 14.1.2017 the informant got information that members of Nuxal organization have to convene meeting in Panchayat Bhawan of village Karnpura Bhataulia. The informant and other police officials in the leadership of A.S.p. reached there and surrounded the Panchayat Bhawan. In the meantime, some persons fled away but six persons were apprehended.

No.22936 of 2017 (2) dt.23-05-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.1.2017 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. No arms is said to have been recovered from the possession of the petitioner. The name of the petitioner has come on the disclosure made by the co-accused. Other co-accused has been granted bail vide Cr.Misc.No.22793 of 2017.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Paroo P.S. case No.13 of 2017.
