Petitioner's prayer in the writ petition is to direct the respondents to consider his case for grant of benefit of ACP. Counter affidavit has been filed on behalf of the State wherein it is specifically stated that on 29.12.1997 the petitioner was substantially promoted in the rank of 3rd Grade from the rank of 4th Grade. It is further stated in the counter affidavit that so far as the grant of ACP is concerned, the petitioner has passed the examination

Patna High Court CWJC No.614 of 2015 dt.19-03-2018 2/2 in the year, 2014 and accordingly, he was given the benefit with effect from 22.2.2014 and as such the grievance of the petitioner has been redressed. No rejoinder disputing the said assertion of the State has been filed.

In view of the aforesaid stand of the State, no further orders need be passed.

The application is dismissed.
