In this case, the petitioner is seeking anticipatory bail in connection with Harsidhi P.S. Case No.492 of 2017 (G.R. No.7904 of 2017), registered for the offence punishable under Section 379 of the Indian Penal Code.
The vehicle of the informant bearing registration no. BR 05G-6817 having been taken away by unknown miscreants. The informant has suspected the present petitioner to be involved in the commission of theft as having been stated that six days earlier the petitioner along with two unknown persons came for purchasing his vehicle. So, he has strong suspicion that the petitioner was involved in lifting of his vehicle.

In such view of the matter, the present bail application is not maintainable. Accordingly, the same is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below shall verify whether the petitioner during the period of P/R bond has misused the privilege of bail or not, if there is no misuse of privilege of bail, it is excepted that the Court below will pass the order in the said background.
