Petitioner seeks bail in connection with Fulwaria (Shripur O.P.) P.S. Case No. 115 of 2015 registered for the offence under Sections- 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that allegations levelled are general and omnibus. There is no eye witness to the alleged occurrence. The allegations levelled are not supported by medical evidence. Similarly situated coaccused persons have been granted bail by this Court vide orders dated 06.10.2016 and 25.11.2016 passed in Cr. Misc. Nos. 42376 of 2016 and 41722 of 2016. Petitioner has no criminal antecedent and is in custody since 18.03.2017.
