JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

As per the prosecution case, the informant suspects that all the FIR named accused persons, including this petitioner, committed the murder of his son.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. Informant is not an eye witness of the occurrence and only on suspicion on account of old enmity petitioner has been made accused in this case. Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.64744 of 2021(2) dt.12-07-2022 2/2 prayer for anticipatory bail and submits that petitioner is named in the FIR and during the course of investigation ample material has been collected against this petitioner to show his complicity in the aforesaid crime.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. However, if the petitioner surrenders in the court below and pray for regular bail the same shall be considered by the court below on its own merit without being prejudiced from the order of this court.
