JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sherghati (Dhobi) P.S. Case No. 561 of 2016 instituted for the offence under Sections 414, 420, 467, 468, 471 of the Indian Penal Code and Sections 33 and 34 of Forest Act and 4/40 B.M.C. Rule.

There is allegation against the petitioner and accused Ram Prasad that without valid challan they were carrying coal to Warsaliganj of Nawadah District.

It has been submitted on behalf of the petitioner that he was Khalasi of the truck on which the alleged coal was loaded. It has further been submitted that driver of the truck namely, Ram Prasad has already been granted bail by a coordinate Bench of this Court vide order dated 26.4.2017 passed in Cr. Misc. 16094

Patna High Court Cr.Misc. No.21735 of 2017 (2) dt.17-05-2017 2/2 of 2017.

In such circumstances, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati (Dobhi) P.S. Case no. 561 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
