JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 328/379 of the Indian Penal Code.
The F.I.R. relating to offence of commission of theft, after administering intoxicating substance, is against unknown. During investigation it revealed that the stolen SIM was used by the petitioner and accordingly name of the petitioner surfaced.
Submission of the petitioner is that the petitioner has got no criminal antecedent. He is in custody since 19.02.2017. There is no direct evidence against the petitioner.
Patna High Court Cr.Misc. No.20575 of 2017 (3) dt.20-06-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Kiul, Lakhisarai/Successor Court, in connection with G.R.P. Case No.102 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
