2. The petitioner seeks regular bail in connection with Bousi P.S. Case No.126 of 2022 lodged under Sections 302/34 of the IPC read with Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 28.06.2023 passed in Cr. Misc. No.18642 of 2023 and subsequently rejected vide order dated 04.04.2024 passed in Cr. Misc. No.12637 of 2024.
4. Learned counsel for the petitioner further submits that the petitioner is in custody since 16.12.2022 and till date trial has not been concluded.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.60757 of 2024(3) dt.14-11-2024 2/2 for bail and submits that progress report has been called for. From the report, it transpires that prosecution witness has already been examined and after closing of the prosecution witness, the stage of section 313 of the Cr.P.C. has also been crossed and case is fixed for evidence of defence witness and two defence witnesses have been examined and discharged.
6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present. Therefore, the bail application of the petitioner is hereby rejected.
7. However, the petitioner is directed to support in conclusion of the trial and the Trial Court is directed to conclude the same within 2 months from the date of production of the order.
