Mr.Sanjay Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Parbatta (Maraiya) P.S. Case no. 403 of 2018, registered under Sections 447, 341, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the morning of 01.11.2018, four persons named in the F.I.R., including the petitioner, were phoughing the field of informant Dropadi Devi, when she made protest then all started assaulting her by means of fist and slaps. Thereafter, the dispute was settled by the villagers, but on 01.11.2018, in the night, all the aforesaid persons came at the house of informant and started indiscriminate firing.

No.52497 of 2019(2) dt.22-08-2019 2/2 Learned counsel for the petitioner submits that while petitioner and three others are named in the F.I.R., but no specific allegation has been attributed against the petitioner. Further submission is that allegation of firing made against the petitioner and three others named in the F.I.R., but none had sustained injury.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 403 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
