JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 06-11-2017 The present writ petition has been filed for a direction to the respondents not to cancel the fair price shop licence of the petitioner for which a show cause was asked by the Sub-divisional Officer, Tribeniganj vide letter No. 533 dated 23.09.2014; and for connected reliefs.

2. None appears on behalf of the petitioner despite repeated calls.

3. Learned counsel for the respondents relies on the counter affidavit to submit that Chhatapur P.S. Case No. 236 of 2014 dated 16.09.2014 under Section 7 of the E.C. Act has been instituted in connection with shortage of rice in the shop of the petitioner however, inasmuch as the shortage was found to be of minor quantity, it was not thought proper to continue prosecution against the petitioner. A statement is also made on

Patna High Court CWJC No.1572 of 2015 dt.06-11-2017 behalf of the respondent at the Bar that pursuant to show cause no further action has been taken against the petitioner for cancelling the fair price shop licence.

4. In the above view of the matter, no interference is called for. The writ petition stands dismissed.
