The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 452, 323, 325 and 379 of the Indian Penal Code later on, Section 302 of the IPC was added.

As per prosecution case, informant alleged that on 10.03.2021, when he returned home, he found that his mother was assaulted by the petitioner along with co-accused persons. After that victim told that co-accused namely, Birmani Devi and others had taken away cash of Rs. 22,000/- some ornaments and other articles from her house. It is further alleged that injured died during course of treatment.

Learned counsel for the petitioner submits that the

Petitioner and informant are agnates and there is a land disputed between them due to whcih he has falsely been implicated in this case. The name of the petitioner came into light only on the basis of suspicion and hearsay. There is no eye witness and no consistent evidence against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 25.02.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ghosi P.S. Case No. 124 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jehanabad.
