ANJANA PRAKASH ORAL ORDER 07-01-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in S.T. No.188 of 2013 arising out of Economic Offence P.S. case No.15 of 2012 instituted for the offence under Sections 489(A), 489(B), 489(C) of the Indian Penal Code, pending in the court of 4th Additional District & Sessions Judge, East Champaran, Motihari.

From the report of the Trial Court, it is evident that the accused persons are purposely trying to play hide and seek with the Court in order to frustrate the interest of the prosecution in examining the witnesses.

The Trial Court is directed to take stringent action against the accused persons and shall proceed to take evidence even in their absence unless the Counsel has withdrawn his power on behalf of his Client.

Patna High Court Cr.Misc. No.29496 of 2014 (4) dt.07-01-2015 2/2 Considering that it is evidently a game being played between the accused and the prosecution even though the Petitioner is in custody, I am not inclined to grant bail to the petitioner.

Prayer for bail is rejected.
