The petitioner seeks bail in anticipation of his arrest in connection with Marauna P.S. Case No. 93 of 2017 dated 18.08.2017 instituted for the offences under Sections 147, 148, 149, 447, 447, 341, 323, 324, 325, 307, 354(A), 379, 504 and 506 of the Indian Penal Code and under Section 27 of the Arms Act.
The petitioner along with others is alleged to have given a farsa blow on the head of the younger brother of the informant resulting in injuries on his person.
Learned counsel for the petitioner has submitted that out of the two injuries suffered by the younger brother of the informant, opinion regarding one
Patna High Court Cr.Misc. No.21532 of 2018(2) dt.26-04-2018 2/2 could not be given by the doctor but the other injuries was found to be simple in nature. The weapon of assault is said to be hard and blunt substance. There is a counter version of the occurrence as well. The wife of the petitioner has filed a case against the informant of the present case.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Supaul in connection with Marauna P.S. Case No. 93 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
