Petitioner seeks bail in Mohania P.S. Case No.203 of 2013 instituted for the offence under Section(s) 420/34 Indian Penal Code and Sections 81(2), 81(3) and 81(4) of the Bihar State Value Added Tax Act.

Counsel for the petitioner submits that petitioner is neither consignee nor consignor. He has no concern with the truck. It is further submitted that tax amount has already been paid, which will be apparent from the earlier order passed by this Court.

In the written report, it is alleged against petitioner that he and other accused issued Suvidha Incoming Form D-IX with forged seal in order to evade tax. During interrogation, it

Patna High Court CR. MISC. No.50835 of 2019(2) dt.17-08-2019 2/2 was found that aforesaid document was given to driver of the vehicle at Maharana Line Hotel. The driver disclosed before the authority that he has received forged Suvidha incoming form from this petitioner and two other accused, as named, at Maharana Line Hotel.

As such, name of the petitioner has been disclosed by co-accused.

Petitioner is in custody since 10.07.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur, Bhabua, in connection with Mohania P.S. Case No.203 of 2013, subject to the condition that both the bailors shall be close relative of the petitioner.
