JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-05-2017 The petitioner seeks regular bail in connection with Sakra (Briyarpur O.P.) P.S. Case No. 334 of 2016, registered for offences punishable under section 304(B) of the Indian Penal Code.

The case is under section 304(B) of the Indian Penal Code and allegation against the petitioner who happens to be mother-in-law of the deceased is of committing dowry death. It has been submitted on behalf of the petitioner that except general and omnibus allegation there is nothing against the petitioner and she is in custody for five months. Heard learned A.P.P. also The learned A.P.P. could not controvert the above submission.

No.22539 of 2017 (2) dt.12-05-2017 2/2 Having heard both sides, in view of the facts that petitioner is a lady and has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub-Judge-XIII, Muzaffarpur, in connection with Sakra (Bariyarpur O.P.) P.S. Case No. 334 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without obtaining prior permission from the court concerned, the prosecution is free to move for cancellation of her bail.
