2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks bail in connection with Sathi P.S Case No. 49 of 2024 dated 21.03.2024 registered for the offences punishable under Sections 379, 413 and 414 of the I.P.C.

4. As per the prosecution case, the informant and other police officials raided the house of the petitioner and recovered one motorcycle bearing Registration No. BR22AG 3727 and when documents regarding the said motorcycle was demanded, he failed to submit any documents.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that there is general and omnibus allegation against the petitioner. No incriminating article has been recovered from his possession. It is further submitted that the petitioner found the said motorcycle lying on the road unattended so for keeping safe he brought the same in his house where ingress and egress are open to all. The father of the petitioner is a Ward Member since last two years in Panchayat Election and due to personal enmity and dirty village party politics he has been falsely implicated in the present case. He has no concern with the alleged offence. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 22.03.2024.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Bettiah, West Champaran in connection with Sathi P.S. Case No.

No.64538 of 2024(3) dt.17-02-2025 3/3 49 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
