Accordingly, this application, under Section 482 Cr.P.C., for quashing the orders dated 24.05.2016 and 09.06.2016, passed by the learned Sessions Judge, Patna in Anticipatory Bail Petition No. 2966 of 2016 arising out of S.K. Puri P.S. Case No. 100 of 2016, stands dismissed as withdrawn. Learned counsel for the informant-opposite party no. 2 submits that the petitioner is not appearing in the case for
Patna High Court CR. MISC. No.29838 of 2016(8) dt.01-08-2019 2/2 maintenance brought by the opposite party no. 2 against the petitioner in the Court of learned Principal Judge, Family Court, Patna whereas learned counsel for the petitioner submits that the opposite party no. 2 is not appearing in the case for divorce vide Matrimonial Case No. 282 of 2013 pending in the Court of learned Principal Judge, Family Court, Patna. Since both the cases are pending in the same Court and the parties have knowledge now of the pendency of the cases, hence, they are expected to appear voluntarily in those cases, failing which the learned lower Court may proceed according to law.
