JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Shikarpur P.S. Case No. 426 of 2016, dated 05.10.2016, instituted for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

The informant has alleged that because of the old association, Raj Kishore Mishra was given some operating tools to be used in a sugar factory on a monthly rental of Rs. 10,000/-. Later, when the tools were demanded back, the informant was misbehaved with. So far as the petitioner is concerned, he is only the brother of one of the co-accused

Patna High Court Cr.Misc. No.21552 of 2018 (2) dt.26-04-2018 2/2 person, viz. Jai Prakash Singh with whom he is separate in mess and business. In the First Information Report, the only allegation against him is that when the informant visited the accused persons, he too was also present and misbehaved with the informant.

Considering the nature of accusation, let the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District-West Champaran in connection with Shikarpur P.S. Case No. 426 of 2016.
