The petitioner seeks bail in connection with Rudrapur P.S. Case No. 115 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 306 litres of liquor from the place of occurrence where the petitioner was present and it is alleged that he disclosed that he works as a liner and the liquor does not

Learned counsel for the petitioner submits that the petitioner has been falsely implicated alleging him to be a liner when admittedly the liquor did not belong to the petitioner. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Rudrapur P.S.
