The petitioner is languishing in custody since 27.01.2017 in connection with Jhajha P.S. Case No. 17 of 2017 for the offences instituted under Sections 25(1-b) a and 26 of the Arms Act.

The prosecution story, in brief, is that on 26.01.2016 at about 14.00 hours on the direction of the S.P., Jamui, the informant raided the village-Chapa and caught this petitioner. On search, one country made pistol, Magazine No. 111 and two live cartridges were recovered from possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.01.2017 and the charge sheet has

Patna High Court Cr.Misc. No.23472 of 2017 (2) dt.24-05-2017 2/2 been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. It is alleged that one country made pistol, Magazine and two live cartridges are said to have been recovered from possession of the petitioner. No compliance of Section 100 Cr. P.C. has been made in the present case.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Jamui, in connection with Jhajha P.S. Case No. 17 of 2017. (Sudhir Singh, J) U.K./- U T
