The petitioner seeks bail in Bidupur P.S. Case No. 361 of 2021, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

As per the prosecution case, petitioner is alleged to have kidnapped the minor daughter of informant. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. In fact, there is love affair between the petitioner and the victim girl for the last three years. The victim girl voluntarily left her house and went along with the petitioner to Ara. The victim girl in her statement under Section 164 Cr.P.C has not uttered any foul

Patna High Court CR. MISC. No.65475 of 2021(2) dt.24-02-2022 2/2 against the petitioner and she was medically examined and her age has been assessed between 14-17 years. Petitioner is in custody since 17.08.2021 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail and submitted that victim girl is minor and she has duly supported the prosecution version in her statement under Section 164 Cr.P.C Considering the facts aforesaid and the nature of accusation, I am not inclined to enlarge the petitioner abovenamed on bail.
