The petitioner is languishing in custody since 23.03.2016 in connection with Kadwa P.S. Case No. 207 of 2014 for the offences instituted under Sections 381 and 120(B) of the IPC. The prosecution story, in brief, is that on 10.12.2014, the driver, namely, Md. Javed, has taken away newly purchased Bolero vehicle on fare to village-Sagrath where his vehicle was missing. On query, the driver has not given satisfactory reply. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.03.2017. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. A suspicion has been raised against the

Patna High Court Cr.Misc. No.23450 of 2017 (2) dt.24-05-2017 2/2 petitioner. There is no substantive evidence to suggest his implication in the present case. There is no recovery of any theft property from possession of the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IVth, Katihar, in connection with Kadwa P.S. Case No. 207/2014. (Sudhir Singh, J) U.K./- U T
