JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.10.2013 In connection with Bahera P.S.Case No. 261 of 2013 registered under section 302 and other minor sections of the Indian penal Code.

The accusation against the petitioner is that he gave one chura blow causing head injury to the deceased, and according to prosecution case itself, the fatal blow to the deceased was given by co-accused Dunilal Sahni. The post mortem report of the deceased reveals that the deceased sustained altogether three injuries and out of three injuries one injury is said to be lacerated wound 1⁄2 " x 1⁄2 " muscle deep on the head of the deceased and the doctor

Patna High Court Cr.Misc. No.26978 of 2014 (3) dt.12-01-2015 2/2 opined that the aforesaid injury was caused by hard and blunt substance and not by a pointed weapon.

Accordingly, above named petitioner is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur at Darbhanga in connection with G. R. No. 267 of 2013 arising out of Bahera P.S.Case No. 261 of 2013.
