The Petitioner seeks bail in Mali P.S. Case No.24 of 2017 instituted for the offence under Section(s) 30(a) and 38 of the Bihar Excise Amendment Act.

It is alleged that on the date of occurrence on confidential information police stopped one motorcycle and tempo and on search it was found that 50 pieces of country made liquor were kept in the dicky of the motorcycle and 350 pieces of country made liquor were kept in the tempo.

It has been submitted that the petitioner was merely passenger in the aforesaid tempo. He has no concern with the seized liquor. It has further been submitted that co-accused, Chhotu Kumar, with similar allegation has been granted regular

Patna High Court Cr.Misc. No.23717 of 2017 (2) dt.24-05-2017 2/2 bail by a co-ordinate Bench of this Court by order dated 17.05.2017 passed in Cr. Misc. No.23529 of 2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge IV-cumSpecial Judge, Aurangabad, in connection with Mali P.S. Case No.24 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
