Mr. Binod Kumar 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2018 Heard learned counsels for the petitioner and State. The petitioner being the elder brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the IPC. The prosecution case, as per the written report of Ram Kumar Yadav dated 19.08.2017, submitted to the Station House Officer, Charpokhari Police Station is to the effect that marriage of the daughter of the informant was performed with one Harekrishna Singh on 28.05.2016, but subsequent to marriage, torture was inflicted due to non-fulfillment of the dowry demand. On 18.08.2017 at 12 AM, the daughter of the informant informed the informant that her in-laws are planning to kill her, whereupon the informant contacted to his son-in-law,
Patna High Court Cr.Misc. No.23822 of 2018(2) dt.27-04-2018 2/3 Harekrishna Singh when he conveyed that the daughter of the informant is seriously ill. Subsequently, the informant went to the in-laws house of his daughter where he came to know that the accused persons killed his daughter.
It is submitted by learned counsel for the petitioner that thrust of accusation is against the husband of the victim, Harekrishna Singh, who is under custody. The accusation against the petitioner is omnibus and general. Other similarly situated accused persons, Lalita Devi and Others have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 6689 of 2018.
Learned APP submits that the petitioners are named in the FIR.
Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Udwant Nagar P.S. Case No. 244 of 2017, subject to the condition as laid down under Section 438(2) of
Patna High Court Cr.Misc. No.23822 of 2018(2) dt.27-04-2018 3/3 the Cr. P.C.
