Mr. Satyadeo Singh Yadav, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and Shri Satyadeo Singh Yadav, learned A.P.P. for the State through virtual court proceedings.

The petitioner seeks bail in connection with Muffasil P.S. Case No. 191 of 2021 instituted for the offences under Sections 30(a) (d) and 41 of the Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 08.07.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and is a lady.

Learned counsel for the petitioner submits that allegation is that one Ganesh Chauhan died because of drinking spurious liquor at the house of Rohan Chauhan and 3.5 litres of country-made liquor was also found in the house of Rohan

Learned counsel for the petitioner submits that the petitioner being wife of Rohan Chauhan has been implicated in this case. It is further submitted that Rohan Chauhan is in custody and the allegation that Ganesh Chauhan died because of having spurious liquor is on Rohan Chauhan as spurious liquor was also found in his house.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.07.2021, charge-sheet has been submitted in the case, petitioner is a person with clean antecedent and is a woman, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Muffasil P.S.
